Definition
If a person has been assessed as lacking capacity to make a specific decision at the time that it needs to be made, then any action taken or decision made for or on behalf of that person must be done in a way that will have the most benefit to them (their ‘best interests’).
This is principle 4 of the Mental Capacity Act 2005.
