There has been growing uncertainty and inconsistency across the sector about the employment status of people who provide care and support, such as Personal Assistants and micro-providers.
People have been asking for clearer explanations of how employment status principles apply in practice, particularly as misunderstandings can create legal and financial risk for individuals and organisations.
Personal Assistant Employment Status: A Guide to Support Good Practice has been developed in response to that need. Drawing on current legislation, relevant case law and multi-agency discussion, the guide explores how employment status works in the context of Direct Payments and offers practical scenarios and indicators to support informed decision-making. Its aim is to reduce confusion and promote more consistent, confident practice.
At the same time, the guide recognises the importance of flexibility and personalised support. Self-employed models and micro-providers can play a valuable role, provided arrangements are structured lawfully and reviewed appropriately over time.
This webinar will provide an opportunity to learn more about how the guide was produced, how it is envisaged to be used, and what it is not intended to do. We will also reflect on the wider context and the shared responsibility for supporting people to navigate complex legal frameworks.
